Overview
Social Hub is operated by Majestic ("we", "our", or "us"). These Terms of Service govern your organization's and authorized users' access to and use of our software-as-a-service platform, dashboards, analytics, messaging tools, AI features, and related services. Please read them carefully.

1. Acceptance of Terms
By accessing or using Social Hub, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Description of Service
Social Hub is a software-as-a-service platform for business intelligence, competitive monitoring, and operational workflows. Depending on your subscription plan and enabled features, the service may include:
- competitor and market monitoring across supported public sources
- social media analytics, publishing, messaging, and moderation tools
- restaurant, menu, pricing, review, and promotion tracking
- AI-powered analysis, chat, summaries, recommendations, and alerting
- reporting dashboards, exports, team collaboration, wallet, and subscription features

3. Accounts, Workspaces, and Authorized Users
You are responsible for your account, workspace, team users, and credentials. You agree to:
- provide accurate registration and billing information
- keep login credentials and API-connected accounts secure
- ensure that anyone invited into your workspace is authorized by your organization
- promptly notify us if you suspect unauthorized access or misuse
You are responsible for activity carried out through your account or workspace unless caused by our own unauthorized actions.

4. Connected Accounts, External Providers, and Third-Party Platforms
Some parts of the service rely on third-party platforms, data providers, AI services, messaging providers, payment providers, or public online sources. These may include Meta / Instagram, WhatsApp Business, review platforms, maps, menu sources, restaurant data sources, and supported social platforms such as TikTok, X, Snapchat, or similar services.
By connecting an account, enabling an integration, or asking us to monitor a source, you:
- authorize us to access, process, store, or display the data needed to provide the requested feature
- confirm that you have the right and authority to connect that account or instruct that monitoring
- agree to comply with the applicable third-party terms, API rules, and platform policies
- understand that third-party availability, APIs, policies, and data access may change at any time
We are not affiliated with, endorsed by, or sponsored by any third-party platform unless explicitly stated.

5. Customer Content, Instructions, and Public Data
You retain ownership of content, data, files, prompts, messages, and materials you submit to the service, subject to the rights needed for us to provide and operate the platform.
You grant us a limited right to host, process, analyze, transmit, cache, format, and display such data as necessary to provide the service.
If you instruct us to collect or analyze competitor, market, menu, review, or social data from public sources, you are responsible for using those outputs lawfully and in accordance with applicable source restrictions and platform rules.

6. Acceptable Use and Platform Restrictions
You agree not to:
- Use the service for any illegal purpose or in violation of any applicable laws
- attempt to gain unauthorized access to the platform, other users' data, or connected third-party services
- use the service to harass, deceive, spam, abuse, defame, or harm others
- upload malicious code, automate abusive traffic, or interfere with security, integrity, or performance
- use messaging, publishing, or campaign tools in breach of law or platform policy
- use the service to create unlawful surveillance, unlawful profiling, or unauthorized scraping activity
- resell, republish, or redistribute paid outputs, datasets, or protected materials in violation of applicable rights or written restrictions
- use the service in any way that violates third-party platform terms, source restrictions, or community guidelines

7. AI-Assisted Features and Customer Responsibility
The service may provide AI-generated summaries, classifications, alerts, recommendations, pricing suggestions, sentiment analysis, or chat responses.
AI outputs are assistive only and may be incomplete, probabilistic, or incorrect. You remain responsible for reviewing outputs and for all business, legal, pricing, publishing, customer communication, and compliance decisions made using the platform.

8. Subscription Plans, Billing, Wallet, and Electronic Records
Access to Social Hub requires an active subscription unless we expressly provide a trial, invitation, promotional, or limited-access arrangement. Subscription terms, pricing, usage charges, and billing conditions are presented at the time of purchase or activation. We reserve the right to modify pricing with advance notice. Refunds are handled in accordance with our refund policy.
Where supported by the service, wallet balances, points, usage charges, invoices, receipts, electronic notices, and click-through acceptances may be used as part of the commercial relationship between the parties.
To the extent permitted by applicable law, you agree that electronic records and electronic communications may be used in place of paper records in connection with the service.

9. Data and Privacy
Your use of the service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the service, you consent to our collection and use of data as described therein.

10. Intellectual Property
All content, features, and functionality of Social Hub — including software, design, and analytics outputs — are owned by Majestic and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

11. Service Availability, Feature Changes, and Suspension
We may update, improve, suspend, limit, or discontinue any feature at any time, including when required by security needs, third-party provider changes, legal obligations, or product evolution.
We may suspend or terminate access if you breach these Terms, create legal or security risk, fail to pay applicable charges, or misuse the platform.

12. Disclaimers and Limitation of Liability
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted availability, error-free outputs, or continued access to any third-party API, public source, or external platform.
To the maximum extent permitted by law, Majestic is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of data, loss of profits, or service interruptions.

13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Kuwait.
To the extent relevant to electronic contracts, records, notices, and privacy handling in digital transactions, these Terms are intended to operate consistently with applicable Kuwaiti law, including Kuwait Law No. 20 of 2014 regarding Electronic Transactions, without limiting any mandatory legal protections that cannot lawfully be waived.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuwait, unless applicable mandatory law requires otherwise.

14. Amendments to These Terms
We may update these Terms at any time. We will notify you of material changes via email or a prominent in-platform notice. Your continued use of the service after changes constitutes acceptance of the updated Terms.
